Terms of Service
These Terms of Service ("Terms") govern your use of the Vigil service ("Vigil", "we", "us"), including the gainvigil.com website, the @VigilMarketBot Telegram bot, and any related communications or content.
By using Vigil, you agree to these Terms. If you do not agree, do not use the service.
Who we are
Vigil is operated by Marcell, a private individual based in Hungary, contactable at [email protected].
What Vigil provides
Vigil is a paid information service. We deliver structured analysis of cryptocurrency market structure using the AMDX framework (Accumulation, Manipulation, Distribution, X-phase reset) across yearly, quarterly, and monthly timeframes. Subscribers receive:
- A weekly broadcast every Friday at approximately 22:00 CET, summarising market state and four-tier conviction setups across approximately 300 cryptocurrency instruments.
- On-demand commands inside the @VigilMarketBot Telegram bot, providing per-ticker yearly cycle analysis and quarterly + monthly structural deep dives.
- Periodic updates to the framework, command set, or display when warranted.
Vigil does not provide trade signals with entry, stop, or target levels. Vigil does not place trades for you. Vigil does not access or hold any of your funds.
Not financial advice
Vigil provides educational analysis of cryptocurrency market structure. Nothing on this site, in the bot, in any email, or in any associated communication constitutes financial advice, investment recommendation, solicitation, or an offer to buy or sell any security or financial instrument.
Cryptocurrency trading involves substantial risk, including the risk of total loss. Past framework performance does not predict future results. Market analysis is inherently uncertain.
You are solely responsible for your trading decisions. Vigil and its operator are not licensed financial advisors and assume no liability for any losses, missed opportunities, or other outcomes resulting from your use of the service.

Eligibility
You must be at least 18 years old to use Vigil. By subscribing, you confirm that you are of legal age in your jurisdiction and that you accept these Terms.
Subscription, billing, and access
- Pricing. The current monthly subscription price is displayed on gainvigil.com and during the Stripe checkout process. Prices are in Euros and are subject to change with reasonable notice to existing subscribers.
- Billing cycle. Subscriptions are billed monthly, recurring automatically on the same calendar date each month via Stripe, your card-on-file payment method.
- Activation. After payment, you will receive an activation code by email. You activate access by sending the command
/activate CODEto @VigilMarketBot. Your subscription is considered active from the moment of activation. - Introductory pricing. Subscribers who join before 22 June 2026 receive an introductory rate of €29 per month through 22 June 2026. After this date, the standard subscription price is €108 per month. Existing subscribers approaching the transition will be contacted in advance with continuation options. The 100-seat subscriber cap applies to the introductory period.
Cancellation and refunds
- Cancel anytime. You may cancel your subscription at any time by contacting [email protected] or through the Stripe customer portal link (provided on request).
- Access until end of paid period. Upon cancellation, you retain access for the remainder of the currently paid billing period.
- No partial refunds. Because the service delivers time-sensitive analysis on a weekly cadence, we do not refund the current billing period when you cancel. You are not charged again after cancellation.
- Exception: failure of service. If we fail to deliver the weekly broadcast for two consecutive Fridays through our own fault (excluding force majeure, infrastructure outages beyond our control, or Telegram downtime), you may request a prorated refund for the affected period.
- EU consumer right of withdrawal. Under EU consumer law, you have a 14-day right of withdrawal for digital services. However, by activating your subscription via
/activateand beginning to receive content immediately, you expressly waive this right of withdrawal in accordance with Article 16(m) of Directive 2011/83/EU. If you do not wish to waive this right, do not activate the subscription within the 14-day window.
Failed payments
If a renewal payment fails (card expired, insufficient funds, etc.):
- Your subscription is placed in a "past due" status.
- You retain access for a grace period of 3 days, during which Stripe automatically retries the payment.
- If the payment is not resolved within the grace period, your subscription is cancelled and access is lost.
- You can re-subscribe at any time at the then-current price.
Acceptable use
When using Vigil, you agree NOT to:
- Resell, redistribute, or publicly republish Vigil's analysis, broadcasts, or framework content without explicit written permission.
- Share your subscription access with non-subscribers, including by forwarding broadcast messages to non-subscribing third parties for the purpose of giving them access.
- Use the service to harass, abuse, or threaten the operator or other subscribers.
- Attempt to disrupt, reverse-engineer, scrape, or otherwise interfere with the technical operation of the bot or website.
- Use the service for any unlawful purpose under your jurisdiction or Hungarian law.
Quoting Vigil's analysis briefly in a private conversation (a friend, a chat with another trader) is fine. Wholesale republishing or operating a derivative paid service using Vigil's content is not.
Suspension and termination
We may suspend or terminate your subscription, without refund, if you violate Section 8 (Acceptable Use), if your payments fail beyond the grace period, or if continued service becomes impossible due to circumstances outside our reasonable control.
We may also discontinue the service entirely, with reasonable notice (at least 14 days) and a prorated refund for any portion of a billing period for which service was not delivered.
Intellectual property
The Vigil framework, brand, software, written analysis, and any associated content remain the intellectual property of the operator. Subscribing grants you a personal, non-transferable, non-exclusive licence to access and personally use the content for the duration of your subscription. No other rights are transferred.
Disclaimers and limitation of liability
The service is provided "as is" and "as available". We make no warranties, express or implied, regarding:
- The accuracy, completeness, or timeliness of any analysis.
- The continuous availability of the bot, website, or email delivery.
- The fitness of the service for any particular trading goal.
- The performance of any cryptocurrency instrument mentioned.
To the maximum extent permitted by law, the operator's total liability to you for any claim arising from your use of Vigil is limited to the amount you have paid to Vigil in the 12 months preceding the claim.
This limitation does not exclude or limit liability for (a) gross negligence or wilful misconduct, (b) death or personal injury caused by negligence, or (c) any liability that cannot be excluded under applicable EU consumer law.
Force majeure
We are not liable for failures of service caused by events outside our reasonable control, including but not limited to: Telegram, Stripe, Resend, Cloudflare, or Railway outages; internet infrastructure failures; cryptocurrency exchange data feed failures; government action; natural disasters; or war.
Changes to these Terms
We may update these Terms as the service evolves or as legal requirements change. Material changes will be announced via email to active subscribers at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
Governing law and disputes
These Terms are governed by Hungarian law. Mandatory EU consumer protection rules apply where relevant.
Any dispute that cannot be resolved by direct communication shall be brought before the competent courts of Hungary. EU consumers also have the right to use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
